Welcome to Forkfluence (“Forkfluence,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and online ordering platform (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Use of Service

You must be at least 13 years of age to use this Service. By using the Service, you represent that you meet this requirement. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission

3. User Accounts

You may create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Orders & Payments

All orders placed through the Service are subject to acceptance by the restaurant. We reserve the right to refuse or cancel any order for any reason, including menu availability, pricing errors, or suspected fraud.

Prices are listed in US Dollars and include applicable taxes as displayed at checkout. Payment is processed securely through our third-party payment processor, Stripe. We do not store your full payment card details on our servers.

Refund requests are handled on a case-by-case basis. Please contact the restaurant directly or reach out to our support team.

5. Influencer / Creator Program

Our Creator Program allows approved participants (“Creators”) to earn commissions by promoting restaurants on Forkfluence through trackable referral links and promo codes. By participating, Creators agree to:

• Represent Forkfluence and its restaurant partners honestly and in good faith
• Not engage in misleading or deceptive promotional practices
• Not use spam, bots, or artificial means to generate referrals
• Comply with all applicable FTC disclosure requirements

Commission rates, payout schedules, and program eligibility are determined at our sole discretion and may be modified at any time with notice. We reserve the right to withhold commissions or terminate participation for violations of these Terms.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALBITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
